2. Information

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter "GDPR”) the user (hereinafter, the "User" or, where applicable, the "Users") is informed that the personal data provided through the online platform (hereinafter, the "Platform") available on the website located at the URL www.dailybot.com (hereinafter, the "Web Site"), or in the application for mobile devices (hereinafter referred to as the "Application"), as well as the data derived from your navigation and any other data you may provide in the future will be processed by DailyBot.

The user must carefully read this Privacy Policy, which has been written clearly and simply, in order to help its understanding.

All the personal data requested are obligatory, and it is not possible to register on the Platform if you do not provide us with the complete data, without prejudice to the fact that you may freely view the content of the Platform.

3. Obligation to provide the personal data

Data requested in the forms of the Platform are in general mandatory in order to meet the stated purposes (unless the required field specified the opposite).

Therefore, if these are not provided or are not provided correctly, DailyBot won’t be able to properly provide its services.

4. With what purpose will the personal data of the user be processed?

The personal data provided through the Platform will be processed by DailyBot, according to the following purposes:

  1. Management of the contractual relationship with the User for the contracting of DailyBot’s services.
  2. Manage the registration of the User in the Platform.
  3. Manage, process, send and track the contracting of the services offered by DailyBot.
  4. Manage the collection of services contracted by the User.
  5. Contact the User to help him/her complete the contracting of the services.
  6. Answer the questions raised in the contact forms.
  7. Manage, process and answer the User's petitions, requests, incidents or queries.
  8. To attend the exercise of the Users' rights.
  9. Process, analyze, answer and, where appropriate, execute the exercise of rights requested by the User in accordance with the provisions of Section 12 of this Privacy Policy.
  10. Monitor, secure and claim the problems, incidents or illicit derived from the Users’ activities.
  11. Monitor the activity of the User for security reasons, to fight against fraud and control over the services provided to the User (e.g. geolocation of the scooter).
  12. Analyze, manage and process incidents related to the provision of the service to the User.
  13. Processing of claims, incidences and illicit carried out by the Users due to the contracting of services.
  14. Creation of a User profile through the Platform
  15. Provide the User with the offered customized services through the Platform.
  16. Internal reports and analysis to improve the services offered in DailyBot’s Platform
  17. Analyze, manage and produce internal reports on Users' behavior to implement improvements in the Platform. For more information, please see the point 10 of this Privacy Policy.
  18. Quality and satisfaction surveys.
  19. Carry out and analyze quality and satisfaction surveys related to the services provided by DailyBot’s.
  20. Carry out and analyze reports and analytics obtained from the User’s responses.
  21. Personalized commercial and promotional communications
  22. Send commercial and promotional communications through electronic or conventional means about products similar or identical to services previously acquired or contracted to DailyBot.
5. Which Data from the User will be process by DailyBot?

In the event that the data provided directly by the User who carries out the acceptance of this Privacy Policy refers to other natural persons other than the said User, the said User guarantees having informed and obtained the unequivocal prior consent of those for the processing of their data, in accordance with the purposes set out in these clauses, releasing DailyBot from any liability in this regard. In the specific case of minors, if the applicant is not the legal representative of the minor, the applicant undertakes to obtain the express consent of the minor.

However, DailyBot may carry out periodic verifications to verify this fact, by adopting the corresponding due diligence measures, in accordance with data protection regulations.

6. What is the legitimate basis of the processing of the User's data by DailyBot?

The processing of your data in order to register you on the Platform, manage your requests and petitions through the Platform, is based on the acceptance of this Privacy Policy. In the case of sending commercial communications with information from third parties, you will be asked for express consent in each case. Likewise, we inform you that these processing will in any case be legitimated by the execution of the contract, being necessary for the provision of DailyBot’s services. In relation to the treatment for the sending of newsletters and commercial communications related to DailyBot’s services and the preparation of reports, these are based on the consent given by the user and, where appropriate, on the satisfaction of DailyBot’s legitimate interests.

The processing of the User's data by DailyBot is legitimized by the fulfilment of the contract for the provision of services existing between the parties, as well as, where appropriate, by the legitimate interest and the fulfilment of legal obligations.

The lawfulness of the processing of the personal data will be the following:

  1. Management of the contractual relationship between the user and DailyBot:

  4. The processing of data derived from this purpose is the compliance with the contractual relationship or for the application at the User's request of pre-contractual measures.

  6. All processing deriving from this purpose shall be based on the compliance with legal obligations, in accordance with the applicable data protection regulations.
  7. Monitor, secure and claim the problems, incidents or illicit derived from the Users’ activities:
  8. All processing derived from this purpose will have as a basis for lawfulness the legitimate interest, recognized to the data controller by law.
  9. This legitimate interest is based on ensuring that the services are not used for unlawful purposes and, in the event that they are produced, manage, process and solve the illegal conduct carried out by the User.
  10. Creation of a User profile through the Platform
  11. All the processing resulting from this purpose will have as basis of legitimacy the fulfillment of the contractual relationship.
  12. Internal reports and analysis to improve the services offered and DailyBot’s Platform:
  13. All processing derived from this purpose will have as a basis for lawfulness the legitimate interest, recognized to the data controller by law.
  14. This legitimate interest is based on being able to offer Users both the services of DailyBot and its Platform with the highest quality and best experience possible.
  15. Quality and satisfaction surveys:
  16. All processing derived from the carrying out of quality and satisfaction surveys will have as a basis for lawfulness the legitimate interest, recognized to the data controller by law.
  17. This legitimate interest is based on being able to offer Users both the services of DailyBot and its Platform with the highest quality and best experience possible.
  18. Personalized commercial and promotional communications:
  19. All processing derived from this purpose will have as a basis for lawfulness the legitimate interest, recognized to the data controller by law.
  20. This legitimate interest is based on the consideration of the interest of Users as clients of DailyBot to offer them services through direct marketing.

The User has the right to oppose to the processing of his/her personal data for the purpose of sending personalized commercial communications, including profiling for personalization, at any time and without cost. The user may express this opposition by ticking the corresponding box, clicking on the link established to unsubscribe from commercial communications or by sending an e-mail to the following e-mail address: support@dailybot.co or by adjusting the App through the device settings so that we don't notify the User through push notifications.

Likewise, in the event that the User gives his/her consent for DailyBot to process his/her data for any additional purpose to those mentioned in this Privacy Policy, the User will be duly informed of said processing, and the User himself/herself will be entitled to revoke said consent by contacting DailyBot through the following e-mail address: support@dailybot.co.

7. To whom will the User's data be disclosed?

Your personal data may be disclosed to:

  • Public authorities to the extent necessary to comply with applicable law.
  • Courts to the extent necessary to comply with applicable law.
  • The State Security Forces and Corps to comply with applicable law.
8. International data transfer

DailyBot is a company located in the United States. All the processing carried out by DailyBot will be done within the United States. Additionally, DailyBot informs that information of the Users may be accessed by third parties for the only purpose of provision of its services. Such third parties may be located outside either United States or European Union.

9. Retention of Personal Data

The User's data will be kept during the following periods:

  1. Data provided for registration in the Platform, as well as to manage, process, formalize and monitor the services provided, will be kept during the contractual relationship and, once this relationship is over, during the statute of limitations of the legal actions that may arise from it.
  2. Data provided through contact forms will be kept for the necessary time to process and respond to your request and, once completed, during the statute of limitations of the legal actions arising from that request.
  3. Data used to meet the exercise of the rights of Users, will be retained for the necessary time to carry out the right requested by the User and, once complied with that right, will be retained until the prescription of any liabilities arising from this processing.
  4. Data used to monitor, ensure and claim the problems, incidents or illicit derived from the activities of the Users, will be kept for the necessary period to process and compensate the problems, incidents or illicit related to the conduct of the Users, until the prescription period of their legal actions.
  5. Drafting of reports and internal analysis and implementation of improvements in the services and the Platform DailyBot, will be retained for as long as needed to provide services to Users and until he/she opposes or ceases to be needed to meet the stated purpose and have prescribed any liabilities arising from the provision of services.
  6. Creation of a User profile to offer him/her personalized services though the Platform. The data provided for registration in the Platform, as well as to manage, process, formalize and monitor the services provided, will be kept throughout the contractual relationship and, once this relationship is over, during the prescription period of the legal actions that may derive from it.
  7. Drafting of marketing report and analysis, on aggregated data related to the User’s activities. The data used for the preparation of reports, statistics and analysis shall be kept for the period necessary for the preparation of the said reports and market analysis and, once this has been completed, for the prescription period of the legal actions deriving from the aforementioned request.
  8. Carrying out quality and satisfaction surveys, will be kept for as long as needed to provide services to Users and until he/she opposes or ceases to be needed to comply with the established purpose and have prescribed any responsibilities arising from the provision of services.
  9. Data used to send personalized commercial communications will be treated until the User opposes. To oppose at any time, the User shall check the corresponding box on the forms enabled for this purpose in the registration process, clicking on the link that will appear at the bottom of the commercial communication, sending an e-mail indicating the opposition to the following email address: support@dailybot.co.

In any case, DailyBot will duly block the personal data of the Users, not having access to the same from the moment in which these cease to be necessary to comply with the purpose for which they were collected, being only treated in the event that this is required by the competent judicial or administrative authority in the cases expressly established in the Law.

10. Internal analysis and improvements in the services

To improve the Platform, DailyBot needs to analyze metrics of Users' system usage. DailyBot is also a chatbot whose improvement depends on the enhancement of its artificial intelligence, which makes it necessary to analyze the information and data generated by the Users in the Platform. In this sense, DailyBot will only process the contents and data of the Users who are using a Free Plan. In case the User is registered under a Paid Plan (Startup, Business, Enterprise), DailyBot will not process these data.

Notwithstanding the foregoing, in the event that DailyBot processes the data and content generated by Users such as, for example, the content of conversations, answers to motivational questions, etc., DailyBot will implement the technical and organizational measures necessary to pseudonymize or even anonymize this information.

In any case, the User's privacy is very important to DailyBot, so whenever we process your data we will do so for internal purposes, protecting the confidentiality of our Users and implementing the security and organizational measures necessary to protect such data.

11. Geolocation

Functionalities of DailyBot’s Platform may use geolocation when the device logs on to it or in which it is installed (e.g. smartphone).

The User may directly disable this option in the device or browser itself, however, deactivation of this option may restrict the use of some of the features of the Platform, which may not work properly.

12. Responsibility of the User

The User:

  • Warrants he/she is over 16 years old and the data he/she provides to DailyBot are true, exact, complete and updated. In this sense, the User is responsible for the truthfulness of all the data he/she communicates and will provide updated information, in a way that responds to his / her actual situation.
  • Warrants he/she has informed third persons whose data has been provided, if any, of the aspects contained in this document. You also guarantee you have obtained his/her authorization to provide their data to DailyBot for the purposes indicated.
  • Will be responsible for false or inaccurate information provided through the Platform and for direct or indirect damages which may be caused to DailyBot or to third parties.
13. Exercise of rights

The User may, at any time and free of charge, exercise their rights of access, rectification or suppression, opposition, limitation and portability of their data, requesting it in writing to DailyBot, through any of the following means, attaching in any case a copy of their National Identity Document and specifying the right or rights they wish to exercise in the following mail: support@dailybot.co.

In any case, the User is informed that, in the event that he/she considers that his/her rights recognized by the applicable data protection regulations have been violated, he/she may submit a claim to the Data Protection Agency.

14. California Privacy Rights

DailyBot provides additional details about the personal information we collect about California consumers and the rights afforded to them under the California Consumer Privacy Act or “CCPA”.

For more details about the personal information we collect, please see the sections 3 and 4, above. We collect the information for the business and commercial purposes described in section 6. The sections 7 and 8 explain about information disclosure and transfers. DailyBot does not sell (as the law in the CCPA defines those terms) the personal information we collect and will not sell it without providing a right to opt-out. Please note that we do use third-party cookies for our advertising purposes as further described in our Cookies Policy.

Subject to certain limitations, the CCPA provides California consumers the right to request to know more details about the categories, or specific pieces of personal information we collect (including how we use and disclose information), to delete their personal information, to opt out of any “sales” that may be occurring, and not to be discriminated against for exercising these rights.

California consumers may make a request pursuant to their rights under the CCPA by contacting us at support@dailybot.co. We will verify your request using the information associated with your account, including email address. Government identification may be required. Consumers can also designate an authorized agent to exercise these rights on their behalf.

15. Security Measures

DailyBot will process the User’s data at all times in an absolutely confidential manner and keeping the mandatory duty of confidentiality, in accordance with the provisions of the applicable regulation, adopting the necessary technical and organizational measures to guarantee the security of your data and avoid its alteration, loss, unauthorized processing or access, taking into account the state of the art, the nature of the stored data and the risks to which they are exposed.

16. Changes

The User acknowledges and accepts that he/she has read and understood this Privacy Policy, the contents of which constitute the entire agreement between the User and the Proprietor with respect to the use and processing of his/her personal information within the Platform.

17. Acceptance and understanding

The User acknowledges and accepts that he/she has read and understood this Privacy Policy, the contents of which constitute the entire agreement between the User and the Proprietor with respect to the use and processing of his/her personal information within the Platform.

The User expressly agrees to be bound by the terms of this Privacy Policy, in its entirety and scope, without exception to any of its provisions.

In addition to the provisions contained in this Privacy Policy, the User agrees to comply with the terms and conditions of the Platform.

DailyBot reserves the right to update and make changes to the Privacy Policy even without prior notice to the User. Such changes must become effective at the time of publication in the Platform, where they will be available to the User at all times. In this sense, we recommend the User to regularly check the content of the Policy to be aware of any changes that affect the processing of data within the Platform.
